Whiplash-related Injuries
On 31 May 2021 the government made changes to the claims process for low value road traffic accident (RTA) related personal injury claims, the majority of which are ‘whiplash claims’. In summary a “whiplash injury” is a sprain, strain, tear, rupture or lesser damage of a muscle, tendon or ligament in the neck, back or shoulder, suffered by an individual whilst driving or a passenger in a motor vehicle.
On this date, a new fixed tariff of compensation was introduced and applies to claims arising from RTAs which occur in England & Wales. The table below shows the tariff compensation values:

“Duration of injury” is the duration, or likely duration, of the whiplash injury a person has suffered.
Amounts (subject to regulation):
- the total amount of damages for pain, suffering and loss of amenity payable in relation to one or more whiplash injuries.
- the total amount of damages for pain, suffering and loss of amenity payable in relation to both one or more whiplash injuries and one or more minor psychological injuries suffered on the same occasion as the whiplash injury or injuries.
