Factories are busy environments were accidents can easily happen if health and safety procedures aren’t followed. Your employer has a duty of care to protect your well-being in the workplace and should you become injured through their negligent actions you could make a claim against them.

How should my employer prevent factory accidents?

Your employer has the legal duty to protect your health and safety of in the workplace. In order to mitigate risks as far as reasonably possible your employer should:

  • Conduct regular risk assessments to identify and eliminate possible hazards.
  • Supply staff with the right PPE.
  • Put in place measures to keep the warehouse clean, tidy and free from obstacles and spillages.
  • Regularly inspect equipment to ensure it is in good working order.
  • Ensure that staff are trained to work at height and in manual handling.

How much compensation will I get for a factory accident claim?

Each individual factory accident claim is different, so it is not possible to say exactly how much compensation you will receive. Your claim will be calculated based on a number of different factors including:

Can I claim if my employer has ceased trading?

If you had an accident in a factory that has since ceased trading it may still be possible for you to pursue a claim. The claims process may however take longer than usual as it may take longer to track down the people and information needed.

Your previous employer would have had insurance in place to cover claims of this nature. It is therefore still the insurer’s responsibility to pay-out on compensation claims. The team at True Solicitors will seek to find out who your previous employer’s insurer was, and can also find out if the same company is now trading under another name or been taken over by another business.

Your solicitor will also source information to support your claim such as records of your employment, risk assessments and witness statements.

Will I lose my job if I make claim?

A lot of people are put off from making a factory accident claim out of the fear that they will lose their job. Your employer cannot legally dismiss you on the basis of you making a personal injury claim against them.

No matter what the size of the company, they are required, by law, to have employer’s liability insurance in place, to cover them for worker injuries. It is therefore important to know that your claim will be against your employer’s insurance company and not directly handled by your employer.
