Why do I need a solicitor to sell my home?

It is important to employ the services of a solicitor when selling your home as you are partaking in a legally binding contract between yourself and the buyer of your home. It is therefore important that all paperwork and contracts are completed with the professional guidance of a lawyer.

What is the legal process for selling a property?

With the help of our solicitors the process of selling your property is a relatively straightforward one.  The  legal steps to selling your home in England and Wales are as follows:

1. Sale Agreement
As soon as you have found a buyer for your property we will be in touch with all the paperwork your buyer’s solicitor is likely to request, including:

  • Preparing the Property Information Form and Contents & Fittings List.
  • Obtaining the title deeds for the property
  • Prepare contract of sale
  • Request a settlement figure for your mortgage
  • Work with all necessary parties and arrange a completion date for moving

2. Exchange Contracts 
After the exchanging of contracts between yourself and the buyer of your property we will:

  • Receive the deposit from the buyer as down-payment.
  • Sort final accounts and submit a final settlement figure for your approval
  • Collect balance of funds if required
    Approve the deed of transfer and get you to sign this

3. Sale Completion 
In order to complete the sale of your property we will:

  • Notify the Land Registry of the transfer of ownership of the property
  • Pay off the mortgage
  • Hand over the property deeds and send any remaining balance to you.

Once you have completed the necessary paperwork we will review it and discuss any queries that are likely to be raised in order to avoid delays at a later stage. We will then work tirelessly until completion takes place.

In the early stages we will discuss with you your preferred timescales for completion and do whatever we can to ensure they are met.

How Long Will My Sale Take?

The timescale will largely depend on your buyer arranging their mortgage/ finances and their solicitor being happy with the paperwork and search and survey results on your property.  A sale can be achieved within 4 – 6 weeks if there are no complications. If you have a completion date that needs to be met our conveyancing team will do all they can to ensure it is achieved.
