What type of warehouse accident can I make a claim for?

If you’ve been injured in an accident whilst working in a warehouse, we may be able to help you to make a claim for the following types of accident:

How should my employer prevent warehouse accidents?

Employers have the legal duty to protect the health and safety of their employees in the workplace. In order to mitigate risks as far as reasonably possible your employer should:

  • Conduct regular risk assessments to identify and eliminate possible hazards.
  • Supply staff with the right PPE.
  • Put in place measures to keep the warehouse clean, tidy and free from obstacles and spillages.
  • Regularly inspect equipment to ensure it is in good working order.
  • Ensure that staff are trained to work at height and in manual handling.

How can I make a warehouse accident claim?

To make a warehouse accident claim you can start the process by giving us a call on 0344 854 7000. We will ask you a series of questions to establish the cause of your accident and how your employer’s negligence may have led to your injuries.

If we believe that your case has good prospects, we will agree to take it on, on a No Win, No Fee basis.

Your solicitor will then work to build a case against your employer to prove how they were negligent in causing your injuries. This will involve collecting the following evidence:

  • Witness reports from the scene of the accident.
  • The report in the company accident book.
  • Photos and video evidence from the scene of the accident.
  • Medical records and the findings from an independent medical assessment.
  • Reports from independent health and safety experts.

Your solicitor will present their findings to the third party where they will either accept or deny liability. If liability is denied we will start negotiations as soon as possible, in order to prevent the case from going to court.

If the third party fails to agree to accept responsibility, or will not agree to the compensation payout amount that we believe you are entitled to, we will start court proceedings.

Most claims are settled before the need to go to court, however we will be there to support you throughout the process if attending court does prove necessary.

How much compensation can I expect if I have a warehouse accident?

Each individual warehouse accident claim is different, so it is not possible to say exactly how much compensation you will receive. Your claim will be calculated based on a number of different factors including:

  • The seriousness of the injuries sustained.
  • Your loss of earnings.
  • The rehabilitation treatment required.
  • If care and assistance will be needed on an on-going basis.
  • If home and vehicle adaptations need to be made.
  • Your ability to work in the same capacity in the future.

Use our compensation calculator to get an idea of what your physical injuries could be worth.

Is there a time limit to making a claim?

You need to make your claim within three years from the date of the warehouse accident. The sooner you seek legal advice following the accident the better, when details of what happened are fresh to mind.

Can I make a No Win, No Fee claim?

Our warehouse accident solicitors will handle your claim on a ‘No win, No fee’ basis. Our charges to you are dependent upon the individual type of case, and are typically a percentage of the compensation amount that we obtain for you. The charges will be no more than 25% of your compensation.
