Missed diagnosis: The failure to diagnose an illness or injury, despite reported health issues by the patient.

Late diagnosis: The delayed or late identification of a medical condition or injury, leading to further complications and a delay in treatment.

Incorrect diagnosis: An illness or injury is diagnosed as something else, resulting in the incorrect medication or treatment being given.

Is there a time limit for making a misdiagnosis claim?

You have up to three years from the date you became aware that you were medically misdiagnosed to make a claim. It is advisable to seek legal advice as soon as possible, whilst the information and circumstances around the misdiagnosis are fresh to mind.

You are able to make a claim on a child’s behalf at any time after the misdiagnosis has occurred, before the child reaches the age of 18. After the child has turned 18 they have until they are 21 to make a claim themselves.

If you would like to pursue a claim on behalf of a loved one who has sadly passed away, where a misdiagnosis has contributed towards their death, you can make a claim within three years of that date.
