Manufacturing works accident

The case:

Our client, a fabricator welder was working in his bay fabricating a steel beam. Upon finishing, he indicated to his colleague operating a crane, to collect the beam to move it.

The crane struck the beam knocking it off balance which then hit our client’s arm.

Despite continuing to work the remainder of his shift, our client resorted to attending A&E that evening due to the pain and discomfort he felt in his left arm. Following a series of x-rays and examinations, our client was advised that he had suffered from a ruptured tendon in his left elbow, which required wearing a sling for 6 weeks, combined with evident swelling and bruising and a feeling of overall weakness in his left arm and a disfigurement of the bicep muscle.

Due to suffering ongoing pain in his arm, left shoulder and neck which caused him to wake during the night, our client underwent sessions of physio on his elbow, however the long term prognosis was of permanent loss of strength and continuing pain to his elbow.

How we helped:

Ultimately due to the long-term effects of his injury, our client was unable to return to his previous job and despite numerous attempts was unable to secure any other employment. He was 68 when the accident occurred and had planned to continue working until he was 72. He was awarded £83,000 in compensation which included 2 years past loss of earnings and pension and 2 years future loss of earnings and pension.
