Accident at work settlement of £38,000

The case:
Our client was working in a warehouse, unloading a 40ft trailer. Due to the trailer being loaded incorrectly by colleagues, the stored goods were tilted at an angle. In the process of unloading the trailer, and due to unsafe stacking of the goods, a box fell from c. 2m onto our client, causing injury to his neck and shoulder.
Prior to the accident occurring, a colleague of the client had in fact already made the employer aware of the potentially unsafe nature of the task, however no action was taken.
The client suffered from a labral tear of the shoulder as a direct result of the accident, which required surgery in order to repair the injury followed by physiotherapy during which time the client was unable to work.
How we helped our client:
TRUE were successful in proving that the employer had been in breach of multiple regulations under the Manual Handling Operations Regulations 1992 which involved a risk of injury.
