The case:

Our client, a lorry driver, was using a crane mounted on the trailer of his lorry to make a delivery of building materials to a customer.  A large pin, which was integral to the operation of the crane, sheared, causing the arm of the crane to collapse, allowing the hydraulic ram of the crane arm to swing freely and strike our client with force, in the head.

The client suffered from two deep lacerations to the forehead requiring sutures, bruising to his eye and cheekbone, and concussion.
Following the incident, our client suffered from severe headaches, neck pain and instances of situational anxiety, and was unable to work for a period of time. He has also been left with permanent facial scarring from the lacerations.

True successfully demonstrated that the client’s employer had failed to maintain the work equipment in a sufficient state, working order and in good repair contrary to regulation 5 (1) of the Provision and Use of Work Equipment Regulation 1998, along with 16 other inadequate work equipment allegations.
