Experienced builder awarded compensation after being ignored by site manager

Mr N suffered a nasty shoulder injury at work.

Our client was asked by his employers to break up a 9 inch thick wall, which was 20 metres long, using only a sledgehammer. With 40 years’ experience in building and brick laying, our client asked for mechanical assistance, knowing that a heavy task like this should be tackled with machinery. The machinery was not provided, being told to break up the wall manually.

The Defendant (employer) disputed they were at fault but made a settlement offer prior to us obtaining any medical evidence. We, TRUE obtained medical evidence and issued proceedings arguing that the Defendant had failed to provide a safe system of work, to adequately train their employee and to reduce the risks of manual handling to the lowest level that was reasonably practicable.

Following the issue of proceedings an increased offer of settlement was then made by the employer, which our client accepted.
