£9000 Settlement For Client Injured In Scaffolding Accident

21 October 2019

Share This Story:

Our client was working as a labourer with a roofing company when he was on the roof stacking tiles. He went to get down from the roof, stepping off onto the scaffolding boards, unbeknown to him there was a section of the scaffolding missing that was not adequately marked. He fell through the scaffolding and onto a metal hand rail, causing him to break his left wrist.

The client attended hospital where he was given an X-ray and instructed to wear a splint for 6 weeks, leaving him unable to work. He was given the prognosis of a full functional recovery within 12 months but expected to still have some difficulty with heavy lifting.

True Solicitors were able to prove that the client’s employer was in breach of several of the Work at Height Regulations 2005 Act, including the failure to ensure that working areas were properly planned, appropriately supervised and carried out in a manner which was safe. Along with failing to check that surfaces, rails and other fall protection measures were properly inspected on each occasion before use.

True Solicitors obtained a settlement figure of £9000 for the client to compensate him for his injuries and loss of earnings.

Solicitor Comments:

“Working at height, particularly on construction sites, is hazardous even under perfect conditions, but employees rely on their employer to make sure that all safety regulations are followed and that the job is as safe as it possibly can be.  In this case our client was let down by his employer failing to ensure that the scaffolding platform he was working on was safe.  He was very lucky not to have been much more seriously injured but the injuries that he did sustain were significant and prevented him from working for some time.

Being unable to work and support yourself is a huge financial burden for most working people and personal injury claims are a vital tool in recovering earnings you have lost through no fault of your own.

We also overcame allegations in this case that our client was partially responsible for his own accident, which would have reduced the amount of damages, and we managed to obtain settlement in full, including our client’s loss of earnings”.  – Katie Beddoes – Personal Injury Solicitor
