Warehouse accident leaves client requiring surgery

The case:

Our client, a warehouse picker was sorting out some pallets as requested by his line manager, despite not having received adequate training.

Whilst in the process of arranging them, he felt a sudden sharp pain in his right leg. One of his co-workers had been operating a lollop truck nearby and had collided with our client, trapping his leg between the truck and pallets.

He was suffering with pain, bruising and swelling on his right leg due to the accident, which after examination was diagnosed as soft tissue damage and a complete tear of his anterior tibiofibular ligament and mild anterior lateral gutter synovitis which required surgery to reconstruct his ligament.

His injuries and subsequent surgery left him unable to work for a period of time and he also suffered psychological effects of the accident.

His employer was found to be negligent due in part to breaches of regulations in the Workplace (Health, Safety and Welfare) Regulations 1992.

 

How we helped:

On this occasion, his case did proceed to trial where he was awarded £40,426.10 in compensation which also included an amount for loss of earnings during the period he was unable to work. Furthermore, because the defendant’s pre-trial offer to settle was beaten, our client was awarded £494.30 in penalty interest.
