The case:
Our client suffered a fall whilst getting out of a hot tub and injured her elbow.
She went to A&E where her arm was x-rayed and her injury was diagnosed as a radial head fracture (a break in the radius bone located just below the elbow joint, often caused by a fall onto an outstretched hand), and her arm was placed in a temporary sling.
She attended her local A&E the next day, where following a further x-ray there was some uncertainty as to the type of fracture she had suffered. Her arm was placed in a cast instead of the sling.
She attended for follow up 10 days later in pain and with restricted movements. She was advised that her arm should not have been placed in a cast and was to continue with conservative treatment. At no point was surgery discussed or offered.
How we helped:
The hospital trust accepted liability for misdiagnosing the fracture and for failing to offer early surgery and that as a result, our client suffered a worse outcome, for which she received £11,000 in compensation.
